Your use of this Web site means that you understand and agree to the following terms:  

Website and Content Usage

Wrappers and membership fees are non-refundable and non-transferable.

Downloading wrappers does not transfer ownership, or any intellectual property rights therein, to you.

You agree to access, acquire, and use our wrappers and/or website content under the following Terms and Conditions:

1. Creative Solutions Co. grants you a nonexclusive, nontransferable license to use our wrappers and website content according to the Terms and Conditions of this Agreement.

2. Creative Solutions Co. reserves the right to change Membership Rules, Terms of Use, prices and wrapper designs without notice.  All current Membership Rules and Terms of Use can be viewed at all times via our website.

3. Membership fees and downloadable content are non-refundable and non-transferable.  Membership is subscription based and payment will be automatically charged on your renewal date (or the last business day before your renewal date) unless cancelled prior to this date.  Members are responsible for safeguarding their membership information accurately.  IP addresses and download activities are recorded for abuse and unauthorized usage purposes.  We reserve the right to immediately terminate any membership through written or verbal notification should unauthorized content use or otherwise occur.  Members are not allowed to share a single membership/license with another person unless a commercial license has been purchased.  In no event will Creative Solutions Co. be responsible for any occurred insufficient fund or other bank fees resulting from direct or indirect debits to your credit or debit accounts.

4. By using our website, all participants and/or members agree to release and hold harmless Creative Solutions Co. from and against all claims and damages arising in connection with participation and/or receipt or use of downloadable wrapper files, images, resources and text.

You MAY:

1. modify (add to) wrappers for personal or commercial purposes for a fully customized and printed product modified by the member directly for specific event and specific clientele;

2. display approved wrapper examples (available within our restricted access site) on their website for purposes of selling a fully customized product.  Member may also display customized wrapper images on their site at a resolution of no larger than 72 dpi;

3. modify (add to) the wrapper as necessary for member purposes, provided that the original design stays intact and provided that any such derivative work(s) are not in competition of this website and must also conform to the conditions of this Agreement.

4. the above applies to all but our previously offered wannabe line.  Wannabe wrappers should be used for personal projects only and not for profit under any circumstances.

 You may NOT

1. distribute our wrappers or graphics, electronically or in hard copy, except as specifically authorized above;

2. resell or share (give away) wrappers or graphics without specific client personalization in any way.

3. authorize any third party to use our wrappers or graphics for any purpose or resell, sublicense, or otherwise make available our website content for use or distribution separately or detached from a product or Web page.  This includes, but is not limited to the sharing of log in details, wrappers, or any content made available on our website.  A commercial license must be purchased in order to share any part of the membership.  Commercial license fees begin at $225.00 (covers 1-5 users) per year and must be purchased as a 12 month Platinum membership;

4. under any circumstances, use our wrappers or graphics in connection with any pornographic, obscene, immoral, or illegal materials;

5. use wrapper images or website content to resell, redistribute, share, dismantle, within a collection, via email, or any other media online or offline;

6. offer for download from any web site, give away, or provided to others in whole or in part any of our wrappers, images or graphics to anyone who has not paid for membership, in any manner on any type of media online or offline;

7. use our wrappers, graphics, or website content in any way to compete with us.

Choice Plus Membership Fees:

When you signup for a Choice Plus membership, you pay for the content that is presently available, not for a period of 30 days. Our automated billing cycle begins the 25th of each month. If you join as a Choice Plus member during this cycle you will be billed twice; once for the current month and once for the upcoming month. For instance, if you signup on the 10th of the month and pay $7.95, you will again be billed $7.95 on the 25th of that month (and thereafter) for the next months content.

Modification/Custom Wrapper Requests:

Effective September 28, 2007, all Choice Plus and Platinum members must be a current member for at least 30 days directly preceding a custom wrapper or modification request.

Privacy Policy

We are committed to protecting the privacy of visitors and members to our website.   No personal information about you will ever be sold or traded to a third party.

Indemnification

By using our website and/or products, you agree to defend, indemnify and hold harmless Creative Solutions Co. and it's owners, employees or affiliates from and against any and all claims, damages, losses liability costs and expenses (including but not limited to attorney's fees) arising from or related to your use of our websites and/or products, your violation of this agreement as well as any third-party's rights, including but not limited to infringement of any copyright, violoation of any proprietary right and invasion of any privacy rights. This obligation shall survive any termination of this agreement or membership. Our liability will not exceed the purchase price of the good or services.

Discussion Board Usage

By participating in any discussion board on our site you agree you will abide by the following:

You are to only register and use one user account, having multiple accounts/user names will result in all accounts being terminated. You are expected to have a valid working Email Address and if this is not the case, then that account will be suspended.

You agree not to post any advertising information about your own products or services (sharing candy wrappers or related products is ok - posting items for sale is not)  without first checking with the moderator, doing so without permission will be cause for removal of the posts.

You may not post any material that is libelous, defamatory, obscene, abusive, invades a person's privacy, violates any intellectual property rights, or that would otherwise violate any law. You may not use this board in a commercial manner without permission from Creative Solutions Co. You may not post material that solicits funds, or that advertises or solicits goods or services other than your own works of art. You may not post material known to be false. You may not post or transmit any information, software or other material that contains a virus or other harmful component.

We are not responsible for material appearing in any board on the Wrapper's Choice website.  We are not responsible for screening material posted by users for libel, obscenity, invasion of privacy, copyright or trademark infringement, accuracy, or for any other reason. We retain, however, the right to modify or remove messages or other material that we, in our sole discretion, consider infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. We also reserve the right to edit materials for any other reason. Whether or not we modify or remove such material, users remain solely responsible for the content of their messages or postings.

Your IP Address is recorded automatically. This information is kept confidential, however, if you do post something that results in legal action, if the proper legal demands are made, we will disclose that information over to the proper authorities. We may, at our discretion, terminate or suspend the registration of any board user who violates any of the terms and conditions of use. 

Though this board is a private forum for registered users only, however please exercise caution when disclosing personal information.  Neither the administrators or moderators are responsible for any user's content.

We reserve the right to change our policies at any time.  Any use of our products or websites implies your acceptance to our policies and terms.  Please check our websites regularly for any updates.

DOES NOT WARRANT THAT THE CONTENT CONTAINED IN THE SITE WILL BE FREE FROM ERRORS, INTERRUPTIONS, OMISSIONS, DEFECTS, VIRUSES, OR OTHER DAMAGING ELEMENTS, OR THAT CREATIVE SOLUTIONS CO. WILL CORRECT ANY ERRORS, OMISSIONS, OR DEFECTS. CREATIVE SOLUTIONS CO. USES GRAPHICS THAT ARE DEEMED ROYALTY FREE AND FOR COMMERCIAL USE.   ANY WRAPPER CONTAINING GRAPHICS UNKNOWINGLY USED THAT DO NOT MEET THIS REQUIREMENT WILL BE REMOVED IMMEDIATELY AND WILL NO LONGER BE AVAILABLE FOR USE.  YOU ASSUME THE COST OF SERVICE, REPAIRS, OR CORRECTIONS TO   HARDWARE, SOFTWARE, OR OTHER EQUIPMENT.
